Terms of Service

These terms apply to the sessions, products and services of to be confirmed, doing business as Kova Photo Studio ("Kova," "we," "us"), and to the use of kovaphoto.com. Your session contract includes your package details; if anything in your contract differs, the contract prevails.
We've written them in plain language. If you have questions, ask us before you book.
1. Bookings and deposits
Your date is reserved once you sign the contract and pay the on request deposit. Quotes and requests sent through the website don't reserve dates.
The deposit goes toward your package total. Because reserving your date means we stop offering it to other families, the deposit is non-refundable except as stated in the cancellations section.
The person signing the contract must be an adult. Sessions for minors are booked by a parent or legal guardian.
2. Payments and payment plans
Published prices are "from" prices. Your final package price is confirmed in writing in your contract, with its inclusions. There are no charges that aren't in your contract.

The session balance is due before to be confirmed. Additional products (albums, acrylics, 3D figurines, dresses) are paid before they go into production.
If a payment is late, we may pause delivery or production until it's brought up to date.
Card payments are processed by Stripe through a secure payment link. We will never ask for card details by chat, WhatsApp or text message. If you have a problem with a charge, please contact us first so we can resolve it together.
3. Rescheduling and weather
You can reschedule your session with at least to be confirmed notice, subject to availability. Conditions: to be confirmed
Outdoor sessions: in case of rain, storms, weather alerts or dangerous heat, we'll offer to move your session into the studio or pick another date at no cost. We decide together no later than to be confirmed before the session.
If illness or another serious issue on Kova's side prevents your session, we'll offer another date or an equally qualified photographer from our team, or refund what you paid for the session.
Arriving late may shorten your session time. If we're late, we make up that time.
4. Cancellations
To cancel, let us know in writing (email or WhatsApp). The date of your notice is what counts.
Custom products already in production can't be canceled or refunded.
5. Locations and permits
Some locations require a reservation, permit or entry fee. We confirm the current rules and coordinate it when you book. Those costs aren't included in your package unless your contract says otherwise.
Each location has its own rules and hours, and they can change. If a location closes or changes its rules, we'll suggest an alternative.
6. Experience sessions with partners
In experience sessions (for example, yacht, classic or exotic cars, private jet hangar, helicopter, water adventure, airboat or underwater sessions), the activity is run by an independent partner with its own license, insurance and terms. Kova designs the session and does the photography; Kova does not pilot, drive, captain or operate the activity.
Each partner may ask you to sign its own liability waiver and accept its safety, age, weight, health and conduct rules. For minors, it is signed by a parent or legal guardian. If it isn't signed, the partner may decline to run the activity.
Some experiences have age limits: the helicopter flight is for adults only (18+), and for water activities the operator sets the minimum age. The operator's and crew's instructions must be followed at all times.
Partner fees are listed separately in your quote and contract. They may be paid to Kova or directly to the partner, as stated in writing.
Weather, rescheduling and cancellation of the activity: the operator decides whether the activity can go ahead safely. to be confirmed
The Kova Promise applies only to Kova's photography, not to the activity, vehicle, vessel, aircraft or the partner's services.
Drone shots are taken by an FAA-certified (Part 107) pilot and only where airspace and permits allow. If the flight isn't authorized, the drone add-on isn't charged.
To organize the activity, we share with the partner the details it needs (name, contact, date and whatever its waiver requires), as explained in our Privacy Policy.
7. Dress use and care
Kova collection dresses included in your package are for use during your session and stay at the studio or with our team on location. They can't be taken to events or outside the session unless agreed in writing.
Our team helps you get in and out of the dress. Please avoid eating, drinking (other than water) or using products that could stain while wearing it.
Normal wear is covered. If a dress suffers serious damage, permanent stains or is lost due to misuse, repair or replacement charges apply: to be confirmed
Purchased dresses: the sale conditions on your receipt apply, including alterations and exchanges: to be confirmed
8. Hair and makeup
Tell us before your session about any allergies or skin sensitivities so we can adapt the products. If you prefer, you can bring your own. We use that information only to take care of you and delete it after the session, as our Privacy Policy explains.
For the best result, arrive with clean, dry hair and a makeup-free face, unless we tell you otherwise.
9. Image rights, photo releases and usage
Your personal-use license
Kova keeps the copyright to the photos. When we deliver them, we give you a personal-use license: you can print them, share them with family and friends and post them on your personal social media.
We kindly ask that you tag Kova when you post them, if you'd like, and not apply filters or edits that alter the work while crediting it to Kova.
The personal license doesn't include commercial use (advertising, resale, contests or use by brands). If you need that, contact us about a commercial license.
How we may use your photos
- By default: your photos are private and only delivered in your gallery.
- Portfolio (optional): only with your written portfolio release may we show selected photos on our website and social media.
- Advertising (optional and separate): using your likeness in paid ads requires an additional advertising release, separate from the portfolio release, as Florida law requires (Fla. Stat. 540.08).
You can give, decline or limit each release in your contract, and withdraw it at any time by emailing to be confirmed. Withdrawing doesn't affect your session, your price or the Kova Promise. We'll stop using those photos in new posts and ads and remove them from our website and profiles within a reasonable time.
Minors: for sessions with minors, only their parent or legal guardian can sign or withdraw these releases. We never use photos of minors in ads without the advertising release signed by their parent or guardian.
We deliver the selected, edited photos included in your package. We don't deliver unedited (RAW) files.
10. Photo delivery
You'll receive a sneak peek of your photos within to be confirmed and your full gallery within to be confirmed, counted from the session or from when you choose your photos, depending on your package.
Your private online gallery is password-protected and available for to be confirmed. Please download and back up your photos; after that period, retrieving them may involve a fee.
During very busy seasons or for reasons beyond our control, we'll let you know about any delay.
11. Albums, acrylics and 3D figurines
Before production, we send you a digital proof (album design, acrylic preview or figurine model) for your approval. We include to be confirmed rounds of changes.
Production starts once you approve the proof and pay for the product. Approximate production time: to be confirmed.
Because they are custom pieces, they can't be returned once approved, except for manufacturing defects. If your piece arrives with a defect, let us know within to be confirmed of receiving it and we'll replace or repair it.
3D figurines are made from your photos and may show small differences in color and detail compared with the images. Printed colors may vary slightly from your screen.
You can pick up your pieces at the studio or request shipping; shipping cost and times are confirmed when you order.
12. The Kova Promise
Love your photos or we reshoot. We want you to leave Kova with photos that make you happy.

Email us at to be confirmed or message us on WhatsApp explaining what you didn't like. We'll review your gallery with you and coordinate next steps under the conditions above.
13. Founding Families program
What it is: an opening benefit for the first to be confirmed families or individuals who book their first Kova session during the program, or until to be confirmed, whichever comes first.
The benefit: to be confirmed. It applies when you sign your contract and pay the deposit during the program, and it is written into your contract. Spots are assigned in order of confirmed booking, not in order of application.
The benefit is never tied to a review. You don't have to leave a review, a rating or positive feedback to receive or keep it. If you choose to leave a review, it's your honest, free opinion.
Permission to feature photos: optional. You can say no and still receive the benefit. If you agree, it is signed separately and governed by section 9.
One benefit per family or individual, non-transferable and with no cash value. Eligible services, exclusions and whether it combines with other offers: to be confirmed
If you cancel the session, the cancellations section applies and the benefit is not converted into cash or credit, unless your contract says otherwise. We may close the program early when the spots are filled, and we'll say so on the program page; this doesn't affect contracts already signed.
14. Electronic signature and electronic records
When you electronically sign your contract, photo releases or other documents with Kova, you agree to use electronic signatures and records. Your electronic signature (for example, typing your full name, drawing your signature or checking an acceptance box) has the same legal effect as a handwritten signature, under the federal E-SIGN Act and Florida's Uniform Electronic Transaction Act.
What it covers: contracts, photo releases, accepted quotes, invoices, receipts, notices about your booking and changes to these terms. We'll send them by email or through your client portal.
Your copy: after signing, we email you a complete PDF copy at the address you gave us. You can request a paper copy at no cost by emailing to be confirmed.
What you need: a device with internet access, an up-to-date browser, an active email address and a program that opens PDFs. If your email changes, let us know.
You can withdraw your consent to electronic records at any time by emailing to be confirmed. There's no fee; from then on we'll send documents on paper, which may take longer. Withdrawing doesn't invalidate what you already signed.
Language: you can sign in Spanish or English. You sign for yourself, or as the parent or legal guardian of a minor, and confirm you have the authority to do so.
Text shown next to the signing button: "By typing my name and clicking Sign, I agree to use electronic signatures and records and I electronically sign this document. I have read the Terms of Service."
15. Communications
We communicate with you by email, phone, text message (SMS/MMS), WhatsApp, Facebook Messenger or Instagram Direct, depending on what you choose. Notices about your contract (confirmations, payments, changes) are sent by email or on the channel you agreed to.
We only send you Kova-initiated text or WhatsApp messages if you agreed to them. Marketing messages require separate consent and are never sent to minors. Agreeing to messages is never a condition of purchase.
You can stop messages at any time by replying STOP (or BAJA on WhatsApp), using the unsubscribe link in emails, or asking us. The full conditions are in the Messaging Program Terms, which are part of these terms.
Some calls may be recorded and some conversations may be handled by Kova's AI virtual assistant; we always tell you, and you can ask to speak with a person.
16. Limitation of liability
We protect your files with backups. In the unlikely event that photos are lost or damaged before delivery for reasons beyond our control, our liability is limited to reshooting the affected session or refunding what you paid for it.
We're not responsible for photos that can't be taken due to venue restrictions, weather, other vendors or lack of cooperation from guests.
Please supervise children and your belongings during the session. Kova isn't responsible for personal items.
17. Website use
The text, photos and design of kovaphoto.com belong to Kova or are used with permission. Don't copy or use them without authorization. Quote builder estimates are references and aren't a binding offer.
When using the site, you agree not to:
- Submit false information or someone else's details without their permission.
- Send content that is illegal, offensive, sexual or that involves minors inappropriately.
- Try to access galleries, accounts or systems that aren't yours, or share other people's gallery passwords.
- Use bots, scrapers or automated tools to copy the site or photos, or to submit forms in bulk.
- Interfere with the site's security or operation, or upload viruses or harmful code.
- Use Kova photos to train artificial intelligence systems without our written permission.
We may block access or remove content that breaks these rules. Links to third-party sites (for example, social media, maps or payments) are governed by those sites' terms.

These terms are governed by the laws of the State of Florida, USA. to be confirmed
19. Changes and contact
We may update these terms; the current version is the one posted here. Changes don't affect contracts already signed.
